These Terms and Conditions (“Terms”) govern the use of and purchase of products and services from DS Music Productions, doing business as DS Music Store (“DS Music Store,” “we,” “our,” “us”). By accessing or purchasing from dsmusicstore.com, you (“Customer,” “you,” “your”) agree to these Terms.

  • We reserve the right to suspend or terminate accounts at our discretion.

DS Music Store sells physical goods (e.g., CDs and DVDs) and digital products (e.g., downloadable music, video, and licenses).

  • Digital Downloads:

    • Licensed for personal use only unless otherwise stated.

    • May not be resold, shared, or redistributed in any form.

  • Licenses:

    • Certain products (e.g., performance or reproduction licenses) are sold under separate license agreements.

    • Customers must comply with the terms outlined in the specific license purchased.

    • Commercial use requires an appropriate license.

5. Pricing and Payments

  • All prices are listed in U.S. Dollars (USD) by default.

  • For regions outside the United States, prices may display in the local currency equivalent for customer convenience.

  • The website automatically rounds final displayed prices up to the nearest $0.95 (or local currency equivalent).

  • Accepted payment methods include:
    Shop Pay, Shop Pay Instalments, Visa, Mastercard, American Express, Discover, PayPal Wallet, Amazon Pay, Google Pay, and Apple Pay.

  • Payment must be received in full before an order is processed.

  • DS Music Store reserves the right to adjust pricing at any time without prior notice.

  • Note: For international customers, your bank or card issuer may charge foreign transaction fees or currency conversion fees, which are outside of DS Music Store’s control. These charges are the responsibility of the customer.

6. Shipping and Delivery

We ship worldwide with the following estimated delivery times:

  • Domestic (U.S.): 5–10 business days

  • International: 10–20 business days

Additional Information:

  • Shipping times are estimates only and may be affected by customs, postal delays, or events beyond our control.

  • Customers are responsible for providing accurate shipping information. We are not responsible for orders lost due to incorrect addresses.

  • Any customs fees or import duties are the sole responsibility of the customer.

7. Refunds and Returns

  • Physical Products:

    • Returns accepted within 14 calendar days of purchase.

    • Products must be returned in original, unused condition with proof of purchase.

    • Customers are responsible for return shipping unless the product was defective or incorrect.

  • Digital Downloads:

    • Refunds are only granted in exceptional cases, such as a technical issue preventing access to the file.

    • Once a digital product has been downloaded, it is non-refundable unless required by applicable law.

  • Licenses:

    • All license purchases are final sale and non-refundable.

8. Intellectual Property

  • All content on dsmusicstore.com, including but not limited to audio recordings, videos, images, text, logos, and designs, are the exclusive property of DS Music Productions and are protected by U.S. and international copyright laws.

  • Unauthorised copying, distribution, resale, or reproduction of any content is strictly prohibited and may result in legal action.

9. Prohibited Use

You agree not to:

  • Resell, redistribute, or publicly share digital downloads or licenses without permission.

  • Use our site for any unlawful or fraudulent purposes.

  • Attempt to hack, disrupt, or compromise the website’s security.

10. Limitation of Liability

To the maximum extent permitted by law:

  • DS Music Store shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our products or services.

  • Our total liability for any claim shall not exceed the purchase price of the product in question.

11. Force Majeure

We are not liable for delays or failure to perform due to events beyond our reasonable control, including but not limited to natural disasters, strikes, supply chain interruptions, internet outages, or acts of government.

12. Governing Law

These Terms shall be governed and interpreted under the laws of the United States of America, without regard to conflict-of-law provisions.
Any disputes will be subject to the exclusive jurisdiction of the courts located in CT, USA.

13. Dispute Resolution / Arbitration

  • Any dispute arising out of these Terms shall first be attempted to be resolved through good faith negotiation.

  • If unresolved, the matter will be submitted to binding arbitration under the rules of the American Arbitration Association (AAA).

  • Arbitration shall take place in CT, USA, and the decision shall be final and binding.

14. Privacy Policy

Your use of our website is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal data.

15. Changes to Terms

DS Music Store reserves the right to update or modify these Terms at any time without prior notice.
